TERMS AND CONDITIONS FOR THE PROVISION OF THE ACCOMMODATION SERVICE AT THE TABOR HOTEL BOTANIQUE
Through these terms and conditions (“Terms and Conditions”), the company REALTOR EXPANSION S.A.S, located in VEREDA LOS TANQUES FINCA EL TABOR in the municipality of FILANDIA QUINDIO, identified with NIT No. 901.694.822-3, with electronic address of judicial notification servicioalcliente@botaniquehoteltabor.com and telephone number 318 250 8300 (hereinafter, “El Tabor Hotel Botanique"), informs hotel users of the conditions that regulate the making of reservations and provision of hotel services at El Tabor Hotel Botanique.
1. Acceptance of Terms and Conditions
Making reservations and using the lodging services at El Tabor Hotel Botanique implies the express and full knowledge and acceptance of these Terms and Conditions. If the user does not agree with these Terms and Conditions, they have the full right not to make reservations or use the El Tabor Hotel Botanique lodging services. However, making any reservation or using the lodging services fully demonstrates your full, total and unconditional acceptance of these Terms and Conditions. The user accepts and acknowledges that he/she will comply with the Terms and Conditions contained herein. The user, as a natural person, accepts as set forth in these Terms and Conditions and declares and guarantees that he or she is the user who will make personal and non-transferable use of the reservation service.
2. Regarding the Hosting Contract:
In accordance with article 79 of Law 300 of 1996, modified by article 21 of Law 2068 of 2020, the accommodation contract is a commercial and adhesion contract that is provided with the main purpose of providing accommodation to a third party called guest or in this case user, which may not be less than 30 days. El Tabor Hotel Botanique has as proof of acceptance of the accommodation contract the subscription of the Registration Card and the acceptance of these Terms and Conditions.
3. Termination of the Hosting Contract:
The hosting contract will end in the following events:
• Due to expiration of the agreed term.
• For non-compliance with any of the obligations of the parties and specifically for non-payment of the price charged to the user or for non-payment of food and drinks or other complementary services that the user had charged to the room or his/her room. personal account and that were not included in the initial reservation.
• Due to cases of force majeure, such as natural disasters, pandemics, strikes, among others. Termination of the contract does not exonerate or release the user from payment of outstanding balances.
4. Effects of Termination of the Hosting Contract
Upon termination of the contract, El Tabor Hotel Botanique may:
• Freely dispose of the room used by the user.
• Conduct an inventory of the utilities located inside the room and if you find belongings of the outgoing user, you must secure them in a safe place and notify the user.
• Make an inventory of the room amenities (towels, lamps, linens, television controls, equipment, television, telephones, among other items and minibar consumption (when applicable). Any shortage and/or consumption attributable to the user must be be paid for this at check-out.
5. Custody of money and valuables:
In accordance with article 1195 of the Commercial Code, users may deliver, upon receipt, money and valuable objects to the administrator of El Tabor Hotel Botanique for safekeeping. For this purpose, the delivery of the goods must be made before the official designated by El Tabor Hotel Botanique and the user must compulsorily draw up a record listing the money and/or objects delivered, the date and time of delivery, description of the object delivered, estimated value of the same in Colombian pesos, name of the official who receives the object and name and signature of the user who delivers it. El Tabor Hotel Botanique may refuse to receive objects when they are of considerable value or excessively bulky. The responsibility of El Tabor Hotel Botanique will be that of depositary under the terms of article 1196 of the Commercial Code. Valuable objects such as cell phones, computers, jewelry, money, among others, that remain in the room or service areas other than those that El Tabor Hotel Botanique has designated for receipt, will be at the sole risk of the users. In the latter case, El Tabor Hotel Botanique does not assume any type of responsibility in case of loss, theft or deterioration. El Tabor Hotel Botanique is not responsible for loss, theft or deterioration of the user's objects, including bicycles, cars and other vehicles located in the Hotel. Nor is it responsible for the loss, theft or deterioration of the objects found inside them.
6. Duties of Botanique Hotel Tabor:
• Be registered in the National Tourism Registry.
• Enter into a lodging contract with the guest or user with the main purpose of providing accommodation at a respective price, for a period of less than 30 days and complying with its purpose.
• Keep records of users or guests, by completing the Accommodation Registration Card in the system provided by the National Government. Said Card will serve as proof of the hosting contract, along with the acceptance of these Terms and Conditions.
• Guarantee compliance with tourist services. - Respond and address requests, complaints, claims and requests made by users.
• In the event that El Tabor Hotel Botanique fails to comply with the services offered or agreed in whole or in part, it will have the obligation, at the user's option, to provide another service of the same quality or to refund or compensate the agreed price for the non-fulfilled service. . Now, if you are not able to comply with the agreed service, El Tabor Hotel Botanique, at its own expense, subcontracts it to a third party for its due fulfillment.
• Other obligations established by law.
7. Duties of the User:
• Make appropriate use of the hotel's facilities and resources.
• Provide clear, truthful, complete and sufficient information to make the provision of hotel services possible.
• Take care of and respect the social spaces of hotels.
• Respect the tranquility of all hotel users.
• Not commit acts or conduct considered criminal by Colombian laws.
• Respect the instructions and smoke-free areas.
• Respect for the tranquility of users.
• Comply with the basic rules of coexistence.
• Make rational use of natural resources.
• Compensate for damages and losses caused to the hotel or third parties, as a result of non-compliance with any of the obligations derived from these Terms and Conditions or any legal rule, without prejudice to the main penalty that the law imposes for fault or crime. task.
• Identify yourself to register at the El Tabor Hotel Botanique with a suitable identification document, presenting a citizenship card in the case of being Colombian or a passport or applicable document in the case of foreigners. In the case of minors, a Civil Birth Registry or valid identification document must be presented. If the minor is accompanied by a responsible adult other than his or her parents, he or she must have an authenticated permit where the minor's parents or legal guardians authorize entry to the Hotel.
• Any foreigner residing abroad who enters the national territory without the intention of settling in Colombia and who certifies such condition at check-in with the presentation of the original passport, the Andean card or the Mercosur card with the current physical stamp of Entry and Permanence Permit (PT) or Tourism Permit; or the current Temporary Visa TP-7, or TP-11, or TP-12 or with a visitor Visa stamp that is identified with the letter V, will be exempt from paying VAT on your accommodation. We recommend requesting or verifying with Migration Colombia the stamping of the corresponding stamp physically at the time of entering the country. All Colombians residing abroad to apply for the tax exemption must present an Immigration Card or Residence Certification issued by the Colombian consulate in the country of residence. Remember that passports from another country (without the respective stamp) or driving licenses from abroad are not valid documents to prove residence abroad.
• Pay the value of the accommodation plus the corresponding taxes.
• Pay the value of all the charges that you have made to your account for consumption of products or access to services that were not included in the price of the initial reservation, such as bath towels, room equipment, among others.
• Show up at El Tabor Hotel Botánique only with the people duly registered in the initial reservation. Visitors who are not registered in the initial reservation are not allowed. El Tabor Hotel Botanique refrains from allowing the entry of people who are not staying at the hotel.
• Respect the Check-In and Check-Out times established by El Tabor Hotel Botanique in these Terms and Conditions. As well as to deliver the room on the day and time set by El Tabor Hotel Botanique. If you do not do so, El Tabor Hotel Botanique has the power to charge a half rate and to store the suitcases that are in the room at Check-Out time. It is clarified that El Tabor Hotel Botanique is not responsible for damage, theft or loss of the suitcases or any object found inside them.
• Any activity considered dangerous will be the user's decision and will be carried out under his or her exclusive responsibility.
• Use the hotel facilities, such as televisions, equipment, furniture, among others, found in the room or in the infrastructure of the El Tabor Hotel Botanique in an appropriate manner and preserving them in the state in which they are found. In the event of damage or loss of these elements, the user will be liable for even slight fault. In case of total or partial loss of these objects, the user must pay the price corresponding to their replacement or repair, this amount may be charged to the user's account.
• Allow employees of El Tabor Hotel Botanique access to the room to carry out cleaning work.
• Do not consume food and alcoholic and non-alcoholic beverages not provided by El Tabor Hotel Botanique, since this is totally prohibited, as well as entering homes with this type of products.
• In case of non-compliance due to not showing up or not using the agreed services, a penalty equivalent to the first night of accommodation will be generated.
• If you want to extend or extend the agreed services, you must notify El Tabor Hotel Botanique with reasonable advance notice, subject in all cases to the availability and capacity of the Hotel.
• Other obligations and duties established by law.
8. Check-In (entrance to the hotel) and Check-Out (exit of the hotel) Policy:
Your reservation begins at 3:00 p.m. (3:00 p.m.) on the day of arrival, and ends at 12:00 p.m. (12:00 p.m.) on the day of departure.
9. Breakfast Services Schedule Included:
Our included breakfast has a service schedule, from 7:00 A.M. to 10:00 A.M. Which can be enjoyed in each room or our central dining room.
10. Cancellation and Modification Policy:
You may cancel or modify your reservation(s) without penalty, if you do so before 5 days of your arrival date, if you do not use your reservation and have not canceled or modified it within the established time, You will be charged a penalty of 50% of the accommodation plus taxes and additional services reserved.
Does not apply to non-refundable rates.
11. Withdrawal Policy:
When you reserve our services through www.botaniquehoteltabor.com or through the Reservation Center, you may exercise the right of withdrawal no later than five business days from the purchase confirmation. The withdrawal will not apply for reservations whose arrival date is before five days. To retract, send an email to servicioalcliente@botaniquehoteltabor.com if you made your purchase through the website, or contact the Reservation Center if you made your purchase through said channel. The refund of the money will be made without deductions of any kind, by bank deposit in the name of the holder of the reservation or by reversal to the credit card used for the purchase, depending on the payment method used, within 30 calendar days following the exercise of retraction.
12. Minor Registration Policy:
If you are traveling with your child(ren) under 18 years of age, you must present the identification document of the minor(s) (civil registry), which proves the existence of the relationship. If the minor(s) are not traveling in the company of their parents, you must deliver at the reception, in addition to the minor's identification document (civil registry), the parents' permission, which must be be authenticated by a Notary and accompanied by a copy of the identification document of those who gave the authorization. Without this documentation, minors are not allowed to enter the hotel. 13. Anti-Tobacco Law Policy:
In accordance with the provisions established in Law 1335 of 2009, our El Tabor Hotel Botanique has spaces and environments free of tobacco smoke. Consequently, the guest accepts as an obligation to refrain from smoking in the spaces, areas and environments that are demarcated as smoke-free spaces, as well as in closed spaces, such as rooms, hallways, restaurants, lounges and others. In the event that the guest fails to comply with this obligation, they agree to pay a penalty equivalent to $100,000 COP for failure to comply with their obligations.
14. Authorization for Processing of Personal Data:

15. Children Policies:
a. Up to one child under 7 years old can stay for free, with their parents or guardians using existing beds. (Prior reservation and subject to availability)
b. Breakfast not included for minors who stay for free, this service must be assumed directly at the hotel.
c. 1 child over 7 years old or one adult over 18 years old can stay for an additional fee (tax not included). (Prior reservation and subject to availability).
d. All guests (Adults or minors) must present their identification document at Check-In without exception.
e. Keep in mind that to register at the hotel, the following documents must be presented at the time of Check-In: according to Colombian legislation, the only valid and mandatory documents to register people with Colombian nationality are: Citizenship Card , Immigration Card (Diplomatic Card does not apply), residence permit and for minors Identity Card and/or Birth Registration. With respect to foreigners, the only valid document is the Passport except for countries involved in the MERCOSUR treaty.
f. If the guest checking in with the minor is a relative of the child or his or her legal guardian, a consent signed before a notary by both parents and a photocopy of the identity document of both parents must be presented. In the event that only one of the parents travels with the minor, a travel consent signed before a notary by the absent parent must be presented. g. Every person entering the hotel must register and present the aforementioned documents. Only registered guests of the property are allowed access to the rooms.
h. The Tabor Hotel Botanique complies with law 1329 and 1356 of 2009 to counter commercial sexual exploitation, pornography and sexual tourism of children and adolescents. It is essential to present the minor's identity documents at the time of Check-In.

17. Fortuitous Event or Force Majeure:
In the event of unforeseeable circumstances or force majeure, such as problems with public services, damage to the facilities of the El Tabor Hotel Botanique caused by storms, tremors, earthquakes, riots, riots, strikes, work stoppages or other serious unforeseeable cases or resistors that prevent El Tabor Hotel Botanique from fulfilling the contract, El Tabor Hotel Botanique will only be obliged to return to the CLIENT a sum of money equivalent to the value of the services not provided.
